Furnivisual Store Terms and Conditions

§1. General Information
- The Furnivisual online store (the “Store”) is operated by Erynek Sp. z o.o., ul. Szybisko 26, 30-698 Kraków, Poland, VAT ID: 6793014045, e-mail: office@furnivisual.com, phone: +48 12 268 22 17 (the “Seller”).
- These Terms set out the rules for using the Store, placing orders, and providing digital services consisting of interior visualizations based on materials provided by the Client.
- The Client may be a business (B2B) or a consumer (B2C). When placing an order, the Client may be asked to indicate their status (business / consumer).
- By using the Store, the Client agrees to these Terms.
§2. Definitions
- Store – the platform for selling digital services available at www.furnivisual.com
- Seller – Erynek Sp. z o.o.
- Client – any natural or legal person, or organizational unit placing an order.
- Product / Service – a digital interior visualization created individually for the Client and delivered electronically.
- Client Materials – photos of the product (e.g., furniture) in JPG or PNG format, or a 3D model of the product, as well as other information necessary to create the visualization in the chosen ready-made room offered by the Store. The Client does not provide photos or data of the room itself — the Client selects a ready-made room from the Seller’s offer.
§3. Nature of the Service
- Products offered in the Store are digital, created individually based on Client Materials and the chosen ready-made room.
- The final result depends on the quality, completeness, and accuracy of the Client Materials.
- The Service is provided exclusively digitally and delivered to the e-mail address provided by the Client.
§4. Client Materials
- The Client must provide Client Materials as defined in §2, in particular:
- photos of the product in JPG or PNG format, or a 3D model of the product,
- other information necessary to create the visualization (e.g., dimensions, colors).
- The required minimum quality of photos and models will be specified on the product page.
- Failure to provide or delay in providing Client Materials pauses the order fulfillment.
- The Seller is not responsible for delays or quality of the final result resulting from:
- poor quality of the photos or models,
- incomplete or incorrect data,
- unclear instructions from the Client.
§5. Placing an Order and Starting the Service
- Orders are placed through the Store website.
- The Client must provide a valid e-mail address to which the Product will be delivered.
- An order is considered accepted for processing after:
- payment has been made, and
- all required Client Materials have been provided.
- Service execution begins only after the complete Client Materials have been received, in accordance with §4.
§6. Delivery Time and Method
- The estimated delivery time for the Service is 2–5 business days from the day the complete Client Materials are received.
- The term may be extended in case of:
- need to clarify materials,
- submission of incomplete or incorrect data,
- force majeure.
- The digital Product is delivered electronically to the e-mail address provided by the Client.
- Delivery of the Product is free of charge.
§7. Payments
- Payment methods available in the Store via Shopify Payments include:
- Visa, Mastercard, American Express,
- Apple Pay,
- Google Pay.
- Payment is collected immediately at the time of order.
- Prices are stated in EUR and include VAT, unless stated otherwise.
- VAT / Taxes:
- For sales to business Clients (B2B) with a valid EU VAT number, VAT is not charged, and the Client is obliged to account for VAT in their country (reverse charge).
- In all other cases, VAT is applied according to local law (Poland).
§8. Copyright and Intellectual Property
- Upon full payment, the Client acquires economic copyrights to the completed Product.
- The transfer of rights covers at least the following fields of use:
- publication on websites,
- use in social media,
- use in marketing and advertising materials,
- printing in physical materials.
- The transfer of rights is unlimited territorially and without time limitation, and occurs in exchange for the service fee included in the price of the Product.
- The Client acquires rights only to the final visualization, not to the ready-made room/scenes or other components reused by the Seller for other clients.
- The Seller retains moral rights, which are non-transferable.
- The Seller may use completed visualizations in its:
- portfolio,
- website,
- social media,
- promotional and commercial materials.
- For B2C clients, this may be excluded on request.
§9. Revisions
- Products are created according to the Offer description and Client Materials.
- The Service does not include rounds of revisions.
§10. Complaints and Withdrawal
A. Business Clients (B2B)
- Seller liability under warranty is excluded to the maximum extent permitted by law.
- Complaints regarding delivery (e.g., non-receipt of the file) should be sent to: office@furnivisual.com
B. Consumers (B2C)
- Due to the nature of the Service — a digital product created individually — the Client loses the right of withdrawal after:
- providing complete Client Materials, and
- commencement of the Service with the Client’s explicit consent, given by ticking the relevant checkbox during order placement.
- The Client may withdraw within 14 days, if the above conditions are not met and the Service has not commenced.

§11. Liability
- The Seller undertakes to provide the Service with due care and in accordance with the Product description.
- The Seller is not responsible for:
- delays caused by the Client,
- incorrect use of the Product after delivery,
- indirect damages, lost profits, or data loss.
- The Client may contact the Seller in case of problems with delivered files.
§12. Governing Law and Dispute Resolution
- These Terms are governed by Polish law.
- In disputes with business Clients, the court with jurisdiction over the Seller’s registered office is competent.
- In disputes with consumers, applicable jurisdiction laws apply. The choice of Polish law does not limit consumer protection granted by the mandatory laws of the consumer’s country of residence within the EEA.
§13. Personal Data
- Client data is processed in accordance with GDPR and Polish data protection law.
- Data is processed for order fulfillment, issuing invoices, and communication with the Client.
- Legal basis: performance of the contract (Art. 6(1)(b) GDPR), legal obligations (Art. 6(1)(c) GDPR), and legitimate interest (Art. 6(1)(f) GDPR).
- Clients have the right to access, correct, delete, or restrict the processing of their data and may lodge a complaint with the supervisory authority (PUODO).
- A full Privacy Policy is available on the Store website with detailed information on data processing, retention, recipients, and profiling.
§14. Final Provisions
- The Seller may update the Terms, with the version valid at the date of purchase prevailing.
- The Terms are available on the Store website.
